The regular meeting of the Board of Embalmers and
Funeral Directors was held at the Riffe Center located in Columbus, Ohio. President Ross C. DeJohn called the meeting
to order at 1:02 P.M. Other Board
members present were: John J. Hadley, Pernel Jones, Sr., David B. Tobias,
Kurtis A. Tunnell, and Ronald G. Van Atta.
Also present were: Mollie Martin, Assistant Attorney General, Frank J.
Savage, Inspector, Charles H. Wisby, Inspector, and Ann Cunningham, Executive
Director.

On a motion by Mr. Hadley, seconded by Mr. Tobias, the
minutes of the July 17-18, 2001 meeting were approved. Ayes: 6. Nays: 0. Motion
approved.

Bob Carter, President of the Ohio Funeral Directors
Association, and Steve Gehlert, Executive Director, appeared before the Board
to suggest the elimination of continuing education for licensees based on age
or years of service. After much
discussion, the Board determined that the suggestion was not possible under the
current law, and if legislated, licensees serving as managers and funeral
directors actually in charge and ultimately responsible for a funeral home
would be required to satisfy the continuing education requirement. The Board members agreed to consider
legislation proposed by the OFDA to eliminate continuing education for
licensees with fifty years of service.

Announcements
The Board office was contacted by the Legislative
Service Commission concerning House Bill 322, funeral processions and
liability. The Board supports the
legislation that will improve funeral service.
Ron Van Atta assisted in monitoring the examinations
on July 24-25, 2001, and will be reimbursed for travel expense and paid per
diem.
At the Board's request, Attorney General Betty
Montgomery issued formal Opinion 2001-029 on July 24, 2001. The opinion concerns the involvement of
licensed life insurance agents in the pre-funding of funerals.
Mr. DeJohn and Inspector Savage will represent the
Board at the Pittsburgh Institute of Mortuary Science on August 29, 2001.
Lawbooks were mailed to funeral homes at estimated
cost of $6,983.30.
Mr. Hadley represented the Board at District #10 on
July 24, 2001, at Lake White near Waverly, and he will be reimbursed for travel
expense and paid per diem.

Unfinished Business
The Board reviewed a copy of a report offered by the
Steering Committee of the Joint Regulatory Boards concerning SRS-e.

The Board reviewed a letter and attached report from
Vickie Hall, the sister of the late Audie Hall of West Portsmouth. The Hall Funeral Home is closed, and preneed
accounts have been transferred.
Secretary to thank Ms. Hall for her cooperation and suggest she donate
the funeral home records to the local historical society.

The Board reviewed a letter from the Loewen Group International,
Inc., notification of intent to sell assets or cease doing business. The Loewen Group sold the Long and Folk
Funeral Homes located in St Mary's and Wapakoneta. Applications for funeral home license are expected to be
submitted in the required time frame.

the profession of funeral service.

The Board reviewed a synopsis of the on-line program
offered by the Pittsburgh Institute of Mortuary Science. On a motion by Mr. Tunnell, seconded by Mr. Hadley,
the Board voted to accept an on-line program of study as approved by the
American Board of Funeral Service Education.

The Board members were given an amended schedule of
Board meetings and activities for the remainder of calendar year 2001 and a new
schedule for calendar year 2002. The
Board received a list of current members and information on the American Board
of Funeral Service Education, the International Conference of Funeral Service
Examining Boards, the Council on Licensure, Enforcement and Regulation, and the
Federation of Associations of Regulatory Boards

1. A
letter from Daniel C. Siferd requesting to reinstatement his embalmer's license. On a motion by Mr. Hadley, seconded by Mr.
Tunnell, the Board approved Mr. Siferd's request provided he fulfills the
requirements of Section 4717.08 of the Revised Code, paying the lapsed license
fees and passing the embalmer Ohio laws examination. Ayes: 6. Nays: 0. Motion approved.
2. A
letter from William D. Ebright concerning a funeral home firm title. The Board accepted the firm title change
from "Fisher-Anderson-Ebright Funeral Home" to "Ebright Funeral
home." Secretary to inform Mr.
Ebright that all signage and advertisements
must reflect the new firm title.
3. A
letter from Barbara A. Sacksteder, an apprentice at Hoening Funeral Home in
Fostoria, concerning part-time employment during her apprenticeship. On a motion by Mr. Hadley, seconded by Mr.
Tunnell, the Board approved Ms. Sacksteder's request to work part time provided
it is no more than twenty hours per week.

4. A
letter from Todd Strzalka, an apprentice at the Tomon and Sons Funeral Home in
Cleveland, concerning his eligibility to take the examinations in October. After a review of the forms and letters in
questions, and on a motion by Mr. Hadley, seconded by Mr. Van Atta, the Board
denied Mr. Strzalka's request to take the October 2001 examination because he
certified that his apprenticeship began on November 6, 2000. Ayes: 6.

5. A
letter from Ronald J. Miller, apprentice at McFarland & Son Funeral Home in
Warren, concerning part-time employment.
On a motion by Mr. Tunnell, seconded by Mr. Tobias, the Board voted to
allow Mr. Miller to work part time for no more than twenty hours per week
during his apprenticeship. Ayes: 6. Nays: 0. Motion approved.

Craig M. Schwinnen, reciprocal applicant from Indiana,
appeared before the Board for an interview.
On a motion by Mr. Tunnell, seconded by Mr. Jones, the Board approved
Mr. Schwinnen's application, and will allow him to sit for the embalmer Ohio
Laws examination and the funeral director Ohio Laws examination in October

Inspectors' Reports
Inspector Savage reported that he drove 1,487 miles in
the counties Coshocton, Cuyahoga, Erie, Harrison, Lake, Mahoning, Morgan,
Noble, Portage, Stark, Trumbull, Washington, and Franklin. He made 39 inspections, 12 investigations,
found no violations, and monitored two apprentices. Inspector Savage monitored examination on July 24-25, 2001.
Inspector Wisby reported that he drove 2,132 miles in
the counties of Athens, Champaign, Clermont, Hamilton, and Hocking. He made 13 inspections, 2 investigations,

Executive Session
On a motion by Mr. Jones, seconded by Mr. Tobias, the
Board went into executive session pursuant to Section 121.22(G)(1) of the
Revised Code, to consider complaints and possible disciplinary action against
licensees, and Section 121.22(G)(3) of the Revised Code to conference with the

4717.14(A)(5) of the Revised Code for knowingly permitting an unlicensed person
to engage in the profession or business of funeral directing under her
supervision, specifically for permitting Gerald Polk, an unlicensed person, to

to engage in the profession or business of funeral directing under the funeral

Board voted to withdraw the application for funeral home license submitted by
Charles R. Blessing, at Mr. Blessing's request. Secretary to advise Mr. Blessing to remove all advertisements and
place a retraction in the surrounding newspapers to counter the advertisements
placed in the area yellow pages.

Fiscal
The Board reviewed the July Monthly Transaction
Register, the voucher journal for July, and the revenue journal for July. The Board members were apprised of the progress
made in securing a lockbox to receive renewal applications and fees rather than
to continue to use the out-dated and laborious currently used by the
Treasurer's office. The Board approved
the Executive Director's suggestion to contract with Bank One for the needed
services. The Board staff plans to tour
the facility on August 16.

With the assistance of Linda Clark, the Board reviewed
the grades of the embalmer Ohio laws examinations and the Funeral Service Arts
and Science examinations written July 24-25, 2001. On a motion by Mr. Jones, seconded by Mr. Hadley, the Board voted
that applicants with a score of 75% or higher on the examinations will be
issued on embalmer license number, pending receipt of a properly completed
applications and the initial license fee.
