The regular meeting of the
Board of Embalmers and Funeral Directors was held on the 31st Floor of the
Riffe Center. Vice-President, Ross C.
DeJohn called the meeting to order at 1:03 P.M. Other Board members present were: Virginia S. Cheney, John J.
Hadley, Pernel Jones, Sr., Roger Primm and Kurtis A. Tunnell. Also present were: Mollie Martin, Assistant
Attorney General; Frank J. Savage, Inspector; Charles H. Wisby, Inspector; and
Ann Cunningham, Executive Director.

On a motion by Mr. Hadley,
seconded by Mr. Primm, the minutes of the March 20-21, 2001, meeting were
approved as amended. Ayes: 6. Nays: 0. Motion approved.

The Executive Director
reported that License 2000, the computer system, is progressing slowly, and the
Mrs. Small was attending a L2000 meeting the same afternoon. The Executive Director will attend a liaison
meeting of the OAKS Project (Ohio Administrative Knowledge System), an
integrated system for accounting, budgeting, human resources, payroll, capital
improvement projects, procurement, and fiscal assets management functions. In addition, it was announced that the Board
staff would present a twenty-minute program as part of the Ohio Funeral
Directors Convention scheduled during exhibition hours.

The Executive Director
reported that she along with Mr. Primm, Inspectors Savage and Wisby attended
the Ohio Funeral Directors Association Legislative Reception on March 27,
2001. On March 28, 2001, Assistant
Attorney General Martin, Inspectors Savage and Wisby, Executive Director
Cunningham attended the annual meeting of the Ohio Crematory Operators
Association.

Mr. DeJohn reported that he,
Mr. Jones, and Ms. Cunningham attended the annual convention of the
International Conference of Funeral Service Examining Boards in Clearwater
Beach, Florida, April 7-10, 2001. The
convention met in conjunction with the annual convention of the American Board
and the mortuary science colleges throughout the country. All three attendees felt the convention was
very educational and informative as well as a useful networking opportunity for
the Board.

The Board members received
copies of the Board's section of the Ohio Revised Code, Section 4717, and the
Ohio Administrative Code, Section 4717.

The Board received a letter
from Kevin M. McIver, Assistant Attorney General, Chief, Opinions Section,
confirming receipt of the Board's request for a formal opinion concerning
preneed and insurance.

The Board reviewed a letter
from the Loewen Group, Inc., updated 2000 results to state and provincial
regulators, dated March 23, 2001.

The Board discussed the
proposal offered by 1-800-FUNERAL, and Ms. Martin reported that she needed more
information as to how the entity will advertise.

The Board was given copies
of new letterhead, a revised interview notice, revised complaint
acknowledgement letter, and a revised complaint request for response
letter. The Board accepted all of the
revisions.

The Board determined that
Mr. Hadley and Mr. Primm would monitor examinations along with Inspector Savage
and Wisby on April 24-25, 2001 at the Comfort Inn on 161 in Columbus.

The Board determined that
along with the office staff, Mrs. Cheney, Mr. DeJohn, Mr. Hadley, and Mr. Primm
would represent the Board during the Ohio Funeral Directors Association
Convention, April 25-27, 2001.

Correspondence
1. A letter from Richard C. Armstrong
requesting consideration for relicensure of his embalmer and funeral director
licenses. Matter to be researched by
Ms. Martin, Assistant Attorney General.
2. A letter from Heather L. Nihiser, embalmer
and funeral director apprentice, requesting permission to work part time as a
nurse during her apprenticeship. On a
motion by Mr. Hadley, seconded by Mr. Tunnell, the Board approved Ms. Nihiser's
request provided she works no more than twenty hours per work outside the
apprenticeship. Ayes: 6. Nays: 0. Motion approved.
3. A letter from Joseph A. Marsaglia, Jr.,
Associate Dean of the Pittsburgh Institute of Mortuary Science, requesting
Board representatives for the school's law seminar in August 2001. On
motion by Mr. Hadley, seconded by Mr. Tunnell, the Board approved the
request for Mr. DeJohn and Mr. Savage to present the Board's program on August
23, 2001. Ayes: 6. Nays: 0. Motion approved.
4. A letter Joseph C. Abele concerning
the failure of the Fifth Third Bank to
properly document the Abele Funeral Homes, Inc. preneed report. Secretary instructed to inform Mr. Abele
that the Board has no authority to regulate banks, and that he needs to make a
business decision as to the location of the funeral homes' preneed accounts.
5. A letter from Fred J. Schrembeck informing
the Board that he resigned his position with the Monreal-Brickman Funeral Home
in Eastlake. In additional he requested
information on where he can "hang" his licenses. Secretary to inform Mr. Schrembeck that if
he plans to offer funeral services to the public, he must apply for a funeral
home license at one location. If he
plans to offer his services to funeral homes, for example a trade
embalmer, he may "hang" his
embalmer and funeral director licenses at the funeral home where he is employed
for a majority of his time.
6. A letter from Robert J. Plagge of the B.
J. Meyer Sons Funeral Home in Cincinnati requesting permission to list the new
funeral home, now under construction, in the yellow and pink pages of the
telephone book. Mr. Plagge submitted a
copy of the building permit. The Board
approved Mr. Plagge request.
7. A letter from Health Florkey requesting
reinstatement of his embalmer and funeral director licenses. On a motion by Mr. Tunnell, seconded Mr.
Hadley, the Board approved Mr. Florkey's request provided he meets the requirements
of Section 4717.08 of the Revised Code.

8. A letter from Tom Harris of Harris Funeral
Home in Dayton expressing his thanks for information provided by the Board
office
9. A letter from James A. Morman of the
Gerber -Morman Funeral Home concerning firm title. The Board approved the change of firm title from
"Gerber-Morman Funeral Home" to "Morman Funeral Home." Secretary instructed to inform Mr. Morman
that all advertisements and signage must reflect the change. The Board office will amend its records.
10. A letter from Dawn Scott, president of
District #10 of the Ohio Funeral Directors Association requesting a Board
member to speak to District #10 on July 24, 2001 at the Lake White Club in
Waverly. Mr. Hadley was selected to represent
the Board.

Inspectors' Reports
Inspector Savage reported
that he drove 1,492 miles in the counties Cuyahoga, Lake, Lorain, Mahoning,
Stark, Summit, and Trumbull. He made 6
inspections, 11 investigations, found no violations, and monitored no apprentice.
Inspector Wisby reported
that he drove 2,176 miles in the counties of Hamilton, Highland, Montgomery,
Ross, and Williams. He made 41
inspections, 3 investigations, found eight violations, and monitored three
apprentices.

The Board reviewed the March
Monthly Transaction Register, the voucher journal for March, and the revenue
journal for March.

Executive Session
On a motion by Mr. Hadley,
seconded by Mr. Tunnell, the Board went into executive session pursuant to
Section 121.22(G)(1) of the Revised Code, to consider complaints and possible
disciplinary action against licensees, and Section 121.22(G)(3) of the Revised
Code to conference with the Board's counsel to consider pending

to charge Terrance P. Hennessy and the Hennessy-Bagnoli Funeral Home
with violation of Section 4717.14(A)(5) of the Revised Code, for knowingly permitting
an unlicensed person to engage in the profession of funeral directing;
specifically for permitting Drucilla Tonies to sell a preneed , Dorothy

The following
motions were made pursuant to the report and recommendation of hearing officer,
Marc E. Myers, on the hearing held January 5, 2001, concerning the charge
against Christopher W. Hensley for violation of Section 4717.05(A)(1) of the
Revised Code, which requires applicants to be of good moral character, and
Section 4717.14(A)(4) of the Revised Code, which prohibits immoral or
unprofessional conduct by an applicant or licensee. Both violation are on Mr. Hensley's indictment for grand theft, a
felony of the fourth degree, pursuant to Section 2913.02(A)(2) of the Revised
Code. Objections were received from Mr.
Hensley's attorney, and considered along with the report and recommendation.
