Tuesday - February 20, 2001

Following a luncheon, the regular meeting of the Board of Embalmers and Funeral Directors was held on the 31st Floor of the Riffe Center.  The meeting was called to order at 1:25 P.M. by Ross C. DeJohn, Vice-President.  Other Board members present were: Virginia S. Cheney, John J. Hadley, Pernel Jones, Sr., Roger Primm and Kurtis A. Tunnell.  Also present were: Mollie Martin, Assistant Attorney General; Frank J. Savage, Inspector; Charles H. Wisby, Inspector; and Ann Cunningham, Executive Director.

On a motion by Mr. Hadley, seconded by Mr. Primm, the minutes of the January 16-17 2001, meeting were approved as amended.  Ayes: 5.  Nays: 0.  Motion approved.

The Board asked the Executive Director to secure exhibitor registration tags and a booth for the upcoming Ohio Funeral Directors Association convention.

The Board was reminded to submit their individual financial statements to the Ohio Ethics Commission before the April deadline

The Board was informed that Section 2301.37.3(E)(1) of the Revised Code, required each Board application for license or renewal to include the applicant's social security number.

Mr. Hadley reported that he and Ms. Cunningham were invited to attend the Executive Board meeting of the Ohio Funeral Directors Association on February 13, 2001 to discuss language changes in the proposed executive budget for 2002 and 2003.  Mr. Hadley relayed information about a situation experienced by some licensees concerning Prudential Insurance and insurance assignments.  On a motion by Mr. Tunnell, seconded by Mr. Primm, the Board voted to reimburse Mr. Hadley per diem and travel expenses for representing the Board.  Ayes: 6.  Nays: 0.  Motion approved.

On a motion by Mr. Hadley, seconded by Mr. Jones, the Board voted to send Mrs. Cheney, Mr. Hadley, Mr. Jones, Mr. Primm, Inspectors Savage and Wisby and Ms. Cunningham to the Ohio Funeral Directors Association Legislative Reception in March.  Ayes: 6.  Nays: 0.  Motion approved.

The Board reviewed Medical Board Rule 4731-14-01 of the Ohio Administrative Code relative to promulgating a rule to certify licensees as competent observers.  On a motion by Mr. Hadley, seconded by Mr. Tunnell, the Board voted to ask the Medical Board to remove number 8 of Rule 4731-14-01 O.A.C.  Ayes: 6.  Nays: 0.  Motion approved.

The Board reviewed various news articles relative to the profession of funeral service.

The Executive Director informed the Board that she was invited to participate in Ohio Crematory Operators Association meeting to be held March 28 in Columbus, Ohio.  Inspectors Savage and Wisby, and Ms. Martin, Assistant Attorney General will also attend.

The Board designated Mr. Primm to represent the Board as monitor for the February 27-28, 2001, examinations to be held in the Riffe Center.

 

Correspondence

   1.      A letter from Michael T. Epstein requesting permission to serve his funeral director's apprenticeship at the Epstein Memorial Chapel and his embalmer apprenticeship of the Dwayne R. Spence Funeral Home.  On a motion by Mr. Hadley, seconded by Mr. Tunnell, the Board approved Mr. Epstein's request.  Ayes: 6.  Nays: 0.  Motion approved.

   2.      A letter from Teri A Naylor concerning the Naylor Funeral Home in New Philadelphia.  On a motion by Mr. Hadley, seconded by Mr. Tunnell, the Board approved the request to continue the operation of the Naylor Funeral Home until February 23, 2002, prior to such date a new application for funeral home license is required.  Ayes: 6.  Nays: 0.  Motion approved.

   3.      A letter from David S. Schoedinger concerning a change of firm title.  The Board accepted the change from "Criss-Kirkpatrick-Schoedinger" to "Criss-Schoedinger Funeral Home."  Secretary to inform Mr. Schoedinger that all advertisements and signage must reflect the new title, and all Board records will be amended.

   4.      A letter from Todd A. Sammons concerning funeral home titles relative to the expiration of the twenty-four month period allowed under Sections 4717.06 and 4717.11 of the Revised Code.  The Board accepted the change from "Crouse-Kauber Funeral Home" to "Crouse-Kauber-Sammons Funeral Home," and Warren F. Kauber Funeral Home" to "Kauber-Miller Funeral Home."  The Board records will be amended.  Secretary to inform Mr. Sammons that all advertisements and signage must reflect the changes

   5.      A copy of a letter from T. Scott Gilligan, attorney for the Ohio Funeral Directors Association, to Pam Grandon at the Division of Financial Institutions in the Department of Commerce.  The letter outlined the situation concerning Prudential Insurance and insurance assignments to funeral homes.

Inspectors' Reports

Inspector Wisby reported that he drove 2,079 miles in the counties of Delaware, Franklin, Hamilton, Lucas, Montgomery, and Wood.  He made 62 inspections, 4 investigations, found two violations, and monitored eleven apprentices.

 

Inspector Savage reported that he drove 1,991 miles in the counties of Ashland, Columbiana, Coshocton, Crawford, Cuyahoga, Harrison, Holmes, Jefferson, Lorain, Mahoning, Monroe, Richland, Stark, Summit, Trumbull, and Wayne.  He made 75 inspections, 8 investigations, found two violations, and monitored no apprentices.

Executive Session

On a motion by Mr. Hadley, seconded by Mr. Jones, the Board went into executive session pursuant to Section 121.22(G)(1) of the Revised Code, to consider complaints and possible disciplinary action against licensees, and Section 121.22(G)(3) of the Revised Code to conference with the Board's counsel to consider pending litigation.  Roll call vote: Cheney, Aye; DeJohn, Aye; Hadley, Aye; Jones, Aye; Primm, Aye; Tunnell, Aye.

The following motions were made pursuant to the report and recommendation of hearing officer, Marc E. Myers, on the hearing held December 1, 2000 concerning the charge against Williams M. Deters for violation of Section 4717.05(D) of the Revised Code for failure to satisfactorily complete the requirements for an apprenticeship; specifically, for violation of Section 4717-1-14(I) of the Ohio Administrative Code for failure to serve an apprenticeship full time.

The following motions were made pursuant to the report and recommendation of hearing officer, Marc E. Myers, on the hearing held January 5, 2001 concerning the charge against Robert E. Shaw, Nick J. Ciriello and Dunn Quigley-Ciriello & Carr Funeral Home for violation of Section 4717.14(A)(4) of the Revised Code for unprofessional conduct; specifically for failure to obtain authorization from the person in the next degree of kinship to the decedent for the cremation of Esther D. Matthews on or about February 11, 2000, a violation of Section 4717.22(A)(6) of the Revised Code.  Objections to the report and recommendation were received from the respondent's counsel, Harry A. Tipping and Lesley A. Weigand.

Ciriello be suspended for five (5) days, and that the funeral home license held by Dunn-Quigley-Ciriello & Carr Funeral Home be suspended for five(5) days. Order of the Board:

That funeral director license no. 6042 held by Robert E. Shaw be suspended for a period of thirty (30) days, that funeral director license no. 5617 held by Nick J. Ciriello be suspended for five (5) days, and that funeral home license no. 43-00-1301 held by the Dunn-Quigley-Ciriello & Carr Funeral Home be suspended for five (5) days  The suspensions will begin March 15, 2001.

 

As a result of the suspension of funeral director license no 6042 held by Robert E. Shaw, amendments to the original application for funeral home license must be filed for Dunn-Quigley-Ciriello & Carr Funeral Home located on South Miller Road in Akron to replace Mr. Shaw as manager for the period of suspension.

 

As a result of the suspension of funeral director license no. 5617 held by Nick J. Ciriello, amendments to the original application for funeral home license must be filed for the Dunn-Quigley-Ciriello & Carr Funeral Home located on Grant Street in Akron to replace Mr. Ciriello as manager for the period of suspension.  Also, amendments to the original applications must be submitted to the Board to replace Mr. Ciriello as the funeral director actually-in-charge and ultimately responsible for the Dunn-Quigley-Ciriello & Carr Funeral Homes located in Akron, Cuyahoga Falls, and Stow.

The Board reviewed the January Monthly Transaction Register, the voucher journal for January , and the revenue journal as of January 31.  The Executive Director informed that Board that she would give testimony before the House Agriculture and Development Subcommittee on February 21, 2001, and explained that the Office of Budget and Management was facilitating the proposed language changes.  The Board received copies of the proposed changes for their review.
