Following a luncheon, the
regular meeting of the Board of Embalmers and Funeral Directors was held on the
16th Floor of the Riffe
Center. President, Ronald G. Van Atta
called the meeting to order at 1:25 P.M..
Other Board members present were: Virginia S. Cheney, Ross C. DeJohn,
John J. Hadley, Pernel Jones, Sr., Roger Primm and Kurtis A. Tunnell. Also present were: Mollie Martin, Assistant
Attorney General; Frank J. Savage, Inspector; Charles H. Wisby, Inspector; and
Ann Cunningham, Executive Director.

On a motion by Mr. Hadley,
seconded by Mr. DeJohn, the minutes of the February 20-21, 2001, meeting were
approved as amended. Ayes: 6. Nays: 0. Motion approved.

It was announced that due to
prior commitments Mr. Van Atta will be unable to attend the April meeting, Mr.
DeJohn will be unable to attend the May meeting, and Mr. Tunnell will not be in
Marietta for the June meeting.

The Board was reminded to
submit their individual financial statements to the Ohio Ethics Commission
before the April deadline.

The Executive Director
reiterated that room reservations for the Doubletree Guest Suites Hotel are $90
per night.

The Board discussed the
Legislative Reception hosted by the Ohio Funeral Directors Association on
Tuesday, March 27, 2001. Mr. Hadley
informed the Board that he would not be attending the reception.

the June meeting in Marietta, Ohio, and other obligations already committed
through the end of the fiscal year.

The Board received a copy of
the annual report published by the State of Ohio, Inspector General's Office
for Fiscal Year 2000.

The Board reviewed a memo
from the Conference of Funeral Service Examining Boards concerning continuing
education programs during the
Conference's annual convention in Florida. It was determined that a licensee must submit an individual
application for post approval of a continuing education activity within thirty
days after the event.
Correspondence
1. A letter from Donald B. Willis informing the
Board that he has taken a full-time position with Brown Forward Funeral Home in
Shaker Heights, and he returned the display and renewal licenses for the Donald
B. Willis Funeral Services. Secretary
to confirm that the funeral home is closed, and to request a clearly enumerated
list of any and all preneed.
2. A copy of a letter from Dan Flory,
President of the Cincinnati College of Mortuary Science to Steve Gehlert,
Executive Director of the Ohio Funeral Directors Association, expressing his
concerns about Ohio students serving apprenticeships after mortuary
school. Dr. Flory suggested an
additional option made available to high school students in which the students
"assist" in careers that need employees. The student would gain insight into the funeral profession.
3. A letter from Glynis Gerber, Founder and
CEO of Final Journey concerning sharing at-need revenue with the funeral
home. Final Journey owns the
tele-pneumonic phone numbers of 1-800-FUNERAL and 1-800-CREMATION, and the
company wants to advertise these numbers.
Secretary to inform Ms. Gerber that to advertise funeral service or
cremation requires a license.
4. A letter Amos F. Gregory concerning the
firm title of the L-C Williams Funeral Home, Inc. Secretary to reiterate to Mr. Gregory that he must add the name
of the funeral director actually in charge of and ultimately responsible for
the funeral home according to Section 4717.11 R.C.
5. A letter from Roger D. Thomas informing
the Board that he could not locate the display and renewal licenses for the
Thomas Funeral Home in Dayton.
Secretary to acknowledge receipt of the letter
6. The Board received the display and renewal
licenses along with a clearly enumerated account of preneed from the Hall
Funeral Home in Portsmouth. Secretary
to confirm that funeral home is closed, and to inquiry as to disposition of
preneed accounts.
7. A letter from Jason S. Brown, apprentice
at Mayhew Funeral Home in Jackson concerning ownership and employment at a
monument company. Secretary to seek
clarification as to employment. Is Mr.
Brown working part time at the monument company?
8. A letter from Robert H. Huffer, attorney
for the Defenbaugh-Wise Funeral Home in Circleville informing the Board that
the funeral home was sold to Schoedinger & Co. Secretary to acknowledge receipt of display and renewal licenses
and clearly enumerated list of preneed.

Inspectors' Reports
Inspector Savage reported
that he drove 1,003 miles in the counties of Ashland, Columbiana, Coshocton,
Cuyahoga, Harrison, Jefferson, Lorain, Mahoning, Medina, Monroe, Stark, Summit,
and Wayne. He made 23 inspections, 11
investigations, found two violations, and monitored one apprentice.
Inspector Wisby reported
that he drove 1,368 miles in the counties of Clermont, Hamilton, and
Pickaway. He made 13 inspections, 3
investigations, found one violation, and monitored one apprentice.

Fiscal
The Board reviewed the
February Monthly Transaction Register, the voucher journal for February, and
the revenue journal for February. The
Board received a copy of the testimony used for the House subcommittee on the
state budget, and a copy of the Board's response to the many questions asked by
the first term legislators.
The Board received
information provided by Larry Weaver, Budget Analyst concerning Fund 4K9, the
Professional Licensing Fund and a chart of total expenses for License 2000.

Karla D. Martin, a
reciprocal applicant from West Virginia, appeared before the Board for an
interview. On a motion by Mr. DeJohn,
seconded by Mr. Jones, the Board approved Mrs. Martins's application for
reciprocal embalmer and funeral director licenses. Ayes: 6. Nays: 0. Motion approved.

Executive Session
On a motion by Mr. Hadley,
seconded by Mr. DeJohn, the Board went into executive session pursuant to
Section 121.22(G)(1) of the Revised Code, to consider complaints and possible
disciplinary action against licensees, and Section 121.22(G)(3) of the Revised
Code to conference with the Board's counsel to consider pending

The Board discussed at great
length and detail, a previously closed complaint after the adamant insistence
of the family caused a reinvestigation.
On a motion by Mr. Hadley, seconded by Mr. DeJohn, the Board voted to
send a letter of reprimand to Myron P. Amstutz, apprentice, and the Heyl
Funeral Home for failure to attempt to follow through on family concerns, and
approach the sexton prior to actual burial of Richard Lewis Holmes on or about
April 4, 2000. Roll call vote: Cheney, abstain,
DeJohn, Aye, Hadley, Aye; Jones, Nay, Primm, recuse;
Van Atta, Aye. Motion failed
because four Board members did not concur which is necessary for the Board to
take any action (See Section 4717.03(A) of the Revised Code.)

Examinations
The Board reviewed the grades
of the embalmer Ohio laws examinations and the Funeral Service Arts and Science
examinations written February 27-28, 2001.
Motion by Mr. Hadley, seconded by DeJohn, that applicants with a score
of 75% or higher on the examinations will be issued an embalmer license number,
pending receipt of a properly completed application and the initial license
fee. Motion approved. A list of applicants, their scores, and
license numbers will be entered into the journal. Roll call vote: Cheney, Aye; DeJohn, Aye; Hadley, Aye;
Jones, Aye; Primm, Aye; Van Atta, Aye.
The Board reviewed the
