MINUTES Tuesday, April 15, 1997 The regular meeting of the Board of Embalmers and Funeral Directors was held in the Board's offices in the Riffe Center at 77 South High Street, 16th Floor, Columbus, Ohio. The meeting was called to order at 1:00 P.M. by Ross C. DeJohn, President. Other Board members present were: John J. Hadley, Roger Primm, Robert L. Shank, Jane Stalzer, Kurtis A. Tunnell, and Ronald G. Van Atta. Also present were: Terri W. Meldrum, Assistant Attorney General; Walter E. Krause, Jr., Inspector; Frank J. Savage, Inspector; and Ann Cunningham, Executive Director. __________
In a discussion of upcoming events, the Board decided that Mr. Van Atta, Mr. Hadley, and Mr. Shank would represent the Board at its booth during the Ohio Funeral Directors Convention April 24-25-26, 1997. The members will be reimbursed for one night's travel expenses and paid one day of per diem. Inspectors Savage and Krause, along with secretary Alpheratta Small will represent the Board on Friday, April 26.

Mr. Hadley, Mr. Primm, and Mrs. Stalzer will monitor the Board examinations on Tuesday, April 29, and Wednesday, April 30.

On a motion by Mr. Primm, seconded by Mr. Hadley, the minutes of the March 12-13, 1997, Board meeting were approved. Ayes: 6. Nays: 0. Motion approved.

Inspectors' Report Inspector Savage reported that he drove 2,118 miles in the counties of Carroll, Crawford, Cuyahoga, Harrison, Huron, Jefferson, Lake, Mahoning, Ottawa, Richland, Seneca, Stark, Summit, and Washington. He made 87 inspections, 8 investigations, found five violations, and monitored seven apprentices.
Inspector Krause reported that he drove 3,061 miles in the counties of Adams, Auglaize, Brown, Clark, Clinton, Greene, Hancock, Highland, Jackson, Lawrence, Meigs, Pike, Ross, Scioto, Shelby, Vinton, and Wood. He made 104 inspections, no investigations, found no violations, and monitored three apprentices.

On a motion by Mr. Hadley, seconded by Mr. Shank, the Board went into executive session pursuant to Section 121.11(G)(1) of the Ohio Revised Code, to consider complaints and possible action against licensees or regulated individuals, and Section 121.22(G)(3) of the Ohio Revised Code to conference with the Board's counsel to consider pending or imminent court action. Roll call vote: DeJohn, Aye; Hadley, Aye; Primm, Aye; Shank, Aye; Stalzer, Aye; Van Atta, Aye.
Mr. Tunnell joined the other Board members at this point in the meeting.

Blessing and the Blessing Funeral Home with violation of Section 4717.08(I) of the Ohio Revised Code, for false, misleading and deceptive advertising. On a motion by Mr. Van Atta, seconded by Mr. Shank, the Board rescinded the October 18, 1995, motion charging Donald A. Faulhaber, Jr. and the Faulhaber-Powell Funeral Home with violation of Section 4717.08(H) of the Ohio Revised Code, for loaning a funeral home license. On a motion by Mrs. Stalzer, seconded by Mr. Hadley, the Board rescinded the February 19, 1997, motion charging Donald A. Faulhaber, Jr. and the Grdina-Faulhaber Funeral Home with violation of Section 4717.08(C) of the Ohio Revised Code, and Administrative Rule 4717-1-24(B)(21(b) for operating the funeral home without a full-time manger. Roll call vote: DeJohn, Aye; Hadley, Aye; Primm, Aye; Shank, Aye; Stalzer, Aye; Tunnell; Aye, Van Atta, Aye.
On a motion by Mr. Hadley, seconded by Mr. Shank, the Board rescinded the October 18, 1995, motion charging George J. Farris with violation of Section 4717.08(H) of the Ohio Revised Code, for loaning a funeral home license. On a motion by Mr. Tunnell, seconded by Mr. Primm, the Board approved the settlement agreement negotiated by Terri W. Meldrum, Assistant Attorney General, with Patrick R. Barclay and the Barclay Funeral Home for violation of Section 4717.08(I) of the Ohio Revised Code for false, misleading and deceptive advertising. Unfinished Business The Board reviewed and discussed the adjusted fee schedule to be incorporated into the proposed legislation.
Ms. Cunningham reported that she had testified before the House Finance Committee and the Senate Finance Committee relative to the Board's appropriation in the 1998-99 Budget Bill.
The Board reviewed a letter from Thomas Rue of the Littleton & Rue Funeral Home in response to the Board's order to cease and desist from advertising the name and likeness of unlicensed individuals.
On a motion by Mr. Hadley, seconded by Mrs. Stalzer, the Board voted to order Kim W. Maley, John L. Feucht and the Walter-Schoedinger Funeral Home to cease and desist from advertising the name and likeness of unlicensed individuals. Ayes: 6. Nays 0. motion approved.
On a motion by Mr. Shank, seconded by Mr. Primm, the Board went into executive session pursuant to Section 121.22(G)(1) of the Ohio Revised Code, to consider complaints and possible disciplinary action against licensees on regulated individuals. 6. A letter from Helene Horwath Zielinski concerning part-time employment during her apprenticeship. The Board accepted Mrs. Zielinski's statement that she worked no more than sixteen hour a week.

11. A letter from Jean Schell, Continuing Education Coordinator, International Order of the Golden Rule concerning the OGR's International Conference. 12. A letter from Eugene C. Wackerly concerning the embalmer Ohio laws examination and his funeral director apprenticeship. 13. A letter from Judy Higgins Reardon concerning a continuing education program entitled "The Grieving Child." Secretary to inform Ms. Reardon that the Board reiterates the original decision to grant three (3) hours of continuing education credit.
